Terms & Conditions of Booking at Molly’s View

  1. These Terms and Conditions will become binding on You [the guest] and us (Ms P Martin t/as Molly’s View) when we confirm your booking by sending you a booking confirmation.
  2. We reserve the right to decline or accept a booking request.
  3. All bookings must be accompanied by a deposit (25% of the total holiday home rental cost).
  4. The balance is due 8 weeks before the start of the holiday. If the booking is made less than 8 weeks before the start of the holiday, the full amount is due immediately. If you fail to pay the balance on the due date we shall be entitled to cancel your booking and apply our cancellation provisions, set out below in Section 16a.
  5. We can only hold provisional bookings for two days after the day on which you first ask us to hold the holiday home for you. If you have not confirmed the booking and made a deposit payment by 12 noon on day three, the Provisional Booking will be cancelled, and the holiday home will be made fully available to other customers.
  6. Check in time is 3pm on the day of arrival – this is already considerably earlier than most other accommodation providers. Please help us by not arriving before 3pm.
  7. Check out time is by 10am on the day of departure. Please help us prepare Molly’s View for following guests by leaving promptly.
  8. Payments: You can pay the deposit and balance payment for your holiday by debit or credit card using PayPal.
  9. Smoking or Vaping is not permitted anywhere on Plot 126 Molly’s View, including the deck area or inside the holiday home.
  10. Electricity and Gas for the property is included in the rental price. Charging of electric vehicles is prohibited.
  11. Bed linen and Towels are supplied. We do not supply cots or linen for infants.
  12. Up to 2 Toy Breed or Small Breed dogs can stay at Molly’s View. If you wish to bring a larger breed of dog, or more dogs than 2, please contact us to discuss this. We ask for a refundable deposit of £50 against the risk of damage, infestation or extra cleaning. This is added to your booking invoice, and refunded within 7 days of the date of departure subject to the risks above.
    Dogs must not be left unattended in the holiday home, or your vehicles or dog crates whether indoors or outdoors, or allowed on furniture or beds designed for humans! Dogs must be kept on leads and only exercised in the designated dog exercise areas on the site. We, and the site operators, reserve the right to terminate your holiday home rental if any of these terms are breached.
  13. We shall not be liable to you for any damage or loss to your property arising out of this contract by our acts or omissions.
  14. We may have to make minor changes to our facilities and some may be unavailable due to maintenance or other reasons at any time. This includes on site facilities which are outside our management and control.

Your right to cancel the Booking

  1. When you book, you accept responsibility for the full cost of the holiday even if you are prevented from coming due to unforeseen circumstances and our cancellation provisions below will apply. We strongly advise you to take out cancellation insurance appropriate to your needs.
  2. You may cancel your booking at any time. Please let us know straight away if you have to cancel your booking.
  3. The amount we agree to refund you is dependent on how close your cancellation is to the start of your Booking. This is because we are less likely to recover the cost of your Booking by re-letting the Accommodation. The amount of any refund due therefore decreases as your arrival date approaches:
  4. Notice of cancellation received more than [one month] before your arrival date, and assuming you have paid in full, Refund = 75% of the total cost
  5. Notice of cancellation received between [one week and one month] before your arrival date and assuming you have paid in full, Refund =50% of the total cost
  6. Notice of cancellation received [one week or less] before your arrival date and assuming you have paid in full Refund = 25% of the total cost
  7. You may request a change which will involve moving your booking and, if we agree to accommodate your request, you shall be responsible for any additional costs as a result. If you wish to change/amend your booking an amendment fee of £25 will apply. Such changes made within 2 months of your holiday start date will be subject to the cancellation terms above.

Our right to cancel the Booking

  1. We may cancel the contract for Accommodation at any time with immediate effect if:
    1. you do not pay us when you are supposed to, or
    2. you are in breach of these Booking Terms and Conditions in any other material way and you do not remedy the situation within a reasonable period after we ask you to.
    3. If you do not arrive, or you have not notified us of a later arrival, before 12 pm on the day following the check in date on which your Booking commences we shall be entitled to cancel the Booking and you will not be entitled to a refund.
  2. We will make every effort to provide the Accommodation. However, we may be unable to do so due to an Event Outside Our Control. If an Event Outside Our Control affects the performance of our obligations under these Terms we will contact you as soon as reasonably possible to notify you and we may cancel your Booking and refund your payments in full. We will not be liable for compensation, or responsible for any failure to perform any of our obligations under these Terms and Conditions caused by an Event Outside Our Control.

    We define Events Outside Our Control as any act or event beyond our reasonable control, including without limitation loss of key person, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster.

Guest & Customer Obligations
In booking you agree:

  1. To pay for any losses or damage to the holiday home.
  2. To take good care of the holiday home and leave it in a clean and tidy condition on departure. We reserve the right to make a charge for extra cleaning if the property is not left in a satisfactory condition.
  3. Not to part with possession of the holiday home or share it or any of its contents/inventory with people not listed on the booking form.
  4. Not to exceed the total number of people stipulated in the property description [and/or the Booking Confirmation].
  5. To permit the owners or their agents reasonable access to the property.
  6. To provide such reasonable information (including guest details) as we may require. Please see our Privacy Policy for details on how we use your personal information.
  7. You may not transfer this booking to anyone else without our prior, written, agreement.

Complaints

  1. We try to ensure Molly’s View Holiday Home is prepared and presented to the highest standard so our guests will enjoy their holidays here. If there is anything missing, a problem or cause for complaint please let us know immediately and every effort will be made to assist you. It is frustrating for all parties if you write after your holiday about a problem we could have solved at the time.
  2. Governing Law – the contract embodied in the booking is governed by English law and jurisdiction of English courts
